CONSUMER RIGHTS – WITHDRAWAL – CANCELLATION – REFUND TERMS AND CONDITIONS
1. If you place an order electronically through the website you are using, you are deemed to have accepted the preliminary information form and the distance sales agreement presented to you.
2. Buyers are subject to the provisions of Consumer Protection Law No. 6502 and the Distance Contracts Regulation (Official Gazette: 27.11.2014/29188), as well as other laws in force, regarding the sale and delivery of the product they purchase.
3. Each product purchased is delivered to the person and/or organisation at the address indicated by the buyer, provided that the legal period of 30 days is not exceeded. If the product is not delivered within this period, Buyers may terminate the agreement.
4. The purchased product must be delivered complete, in accordance with the specifications stated in the order and, if any, with documents such as a warranty certificate and user manual.
5. If selling the purchased product becomes impossible, the seller must notify the buyer of this in writing within 3 days of learning of it. The total price must also be refunded to the Buyer within 2 to 20 days.
IF THE PRICE OF THE PURCHASED PRODUCT IS NOT PAID:
7. If the Buyer does not pay the price of the product they purchased or cancels it in the bank records, the Seller's obligation to deliver the product ends.
PURCHASES MADE THROUGH UNAUTHORISED USE OF A CREDIT CARD:
8. If, after the product has been delivered, it is determined that the credit card with which the buyer paid was used unlawfully by unauthorised persons, and the price of the product sold is not paid to the Seller by the relevant bank or financial institution, the Buyer must return the product subject to the agreement to the SELLER within 3 days.
IF THE PRODUCT CANNOT BE DELIVERED ON TIME FOR UNFORESEEABLE REASONS:
9. If force majeure events that the Seller could not have foreseen occur and the product cannot be delivered on time, the Buyer will be notified. The Buyer may request cancellation of the order, replacement of the product with a similar one, or postponement of delivery until the obstacle is removed. If the Buyer cancels the order and paid in cash, this amount will be paid back in cash within 2 to 20 days of the cancellation. If the Buyer paid by credit card and cancels, the price of the product will again be refunded to the bank within 2 to 20 days of the cancellation; however, it may take the bank 2-3 weeks to transfer it to the buyer's account.
RIGHT OF WITHDRAWAL:
Although the relevant law states that the consumer “cannot benefit from the provisions on the right of withdrawal in relation to services performed instantly in electronic form (software, music, video clips that can be instantly downloaded to a computer, used and copied; opened cassettes, CDs, DVDs and similar data storage devices; e-newspaper and e-book deliveries; online products that work with a password over the web) and goods delivered instantly to the consumer”, British Institute, relying on its confidence in the quality and benefit of the product it sells and despite having no legal obligation to the Consumer, grants the right to return the product within fourteen days of the purchase date if the consumer has not received the product. If the consumer has not received the product, the consumer notifies their return request in writing to info@british.com.tr . Within 2 to 20 business days following acceptance of the return request, British Institute deducts a 10% operation fee from the contract amount and refunds the remaining amount in cash to the Consumer's credit card account if they paid by credit card, to the account from which the transfer was made if they paid by bank transfer, or to another account notified by the Consumer in writing. Return requests made after fourteen days and/or through other communication channels will not be considered; our Company will not take back the product or refund its price.

WITHDRAWAL PERIOD:
- If what the Buyer has purchased is a service, and the Buyer has not received the product, this 14-day period starts from the date the contract is signed. The right of withdrawal cannot be exercised for service contracts where performance of the service has begun with the consumer's approval before the withdrawal period ends.
- Costs arising from exercising the right of withdrawal are borne by the BUYER.
- To exercise the right of withdrawal, written notice must be given to the SELLER within 14 (fourteen) days by registered mail with return receipt, fax or e-mail using the contact details stated in Article 12, and the product must not have been used, within the framework of the provisions on “Products for Which the Right of Withdrawal Cannot Be Exercised” set out in this agreement.
15.1. For orders placed using a special discount code / gift voucher off the list price, the return period granted by the company will be 7 (seven) days.
15.2 In any case, whatever the circumstances, a return request must be made no later than 30 calendar days after the order date. Otherwise, no return will be processed under any circumstances. For return requests made within less than 30 days, the relevant provisions written in this agreement apply.
EXERCISING THE RIGHT OF WITHDRAWAL:
- The invoice for the product delivered to a third party or to the BUYER (if the invoice for the product to be returned is corporate, it must be sent together with a return invoice issued by the company when returning it. Returns of orders invoiced in the name of companies cannot be completed unless a RETURN INVOICE is issued.)
- The return form and the products to be returned must be delivered complete and undamaged, together with their box, packaging and standard accessories, if any.
RETURN CONDITIONS:
- The SELLER is obliged, within 2 to 20 business days at the latest from receipt of the written notice of withdrawal, to refund the total price to the BUYER after deducting a 10% operating cost from the total amount to be refunded, to return the documents creating a debt for the BUYER, and to take back the product within 20 days.
- If the product has reached the Consumer, the return processing period begins after the invoice has been returned and, if necessary, IBAN details have been sent to British Institute. British Institute will not be responsible for delays caused by invoices sent late.
- If the value of the goods decreases or return becomes impossible for a reason attributable to the BUYER's fault, the BUYER is obliged to compensate the SELLER's losses in proportion to their fault. However, the BUYER is not responsible for changes and deterioration resulting from the proper use of the goods or product within the withdrawal period.
- If exercising the right of withdrawal causes the purchase to fall below the campaign limit set by the SELLER, the discount obtained under the campaign is cancelled.
PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED:
- Under the Regulation, services performed instantly in electronic form or intangible goods delivered instantly to the consumer, as well as audio or video recordings, books, digital content, software programs, data recording and storage devices and computer consumables, cannot be returned if their packaging has been opened by the BUYER. In addition, under the Regulation, the right of withdrawal cannot be exercised for services whose performance has begun with the consumer's approval before the withdrawal period ends.

DEFAULT AND ITS LEGAL CONSEQUENCES
- If the BUYER defaults when making payments by credit card, they accept, declare and undertake that they will pay interest under the credit card agreement between them and the card-issuing bank and will be liable to the bank. In this case, the relevant bank may take legal action and may claim the resulting costs and attorney's fees from the BUYER, and in all circumstances, if the BUYER defaults on their debt, the BUYER agrees to pay the loss and damage suffered by the SELLER due to the late performance of the debt.
